Why Elections in Ukraine Won’t Be Happening Anytime Soon

There has been increased discussion on social media that Ukraine has “cancelled” elections that were scheduled to take place. However, this is a simple lack of awareness of the Ukrainian constitution and willful ignorance of the realities of the ongoing conflict with Russia.

Constitution

Ukraine’s constitution explicitly states that elections cannot be held while martial law is in effect. This measure ensures that elections are conducted under conditions that allow for fairness, security, and inclusivity, which are difficult to guarantee during times of war. Martial law was declared in Ukraine on February 24, 2022, following the full-scale invasion by Russia, and it remains in effect due to the ongoing conflict.

Under the current legal framework, parliamentary and presidential elections are prohibited during martial law. According to Ukraine’s constitution, elections can only be held six months after martial law is lifted​.

Challenges of Wartime Elections

Security Concerns: Conducting elections during an active conflict poses significant security risks to voters, election officials, and international observers. Ensuring the safety of polling stations and the integrity of the election process is nearly impossible with ongoing military operations​.

Displacement of Voters: Millions of Ukrainians have been displaced internally and externally due to the war. Updating voter lists and ensuring that displaced persons can vote presents a major logistical challenge​.

Infrastructure Damage: Many regions, especially those near the front lines, have experienced severe infrastructure damage, making it difficult to set up and manage polling stations​.

Financial Constraints: Funding elections during a time when resources are heavily allocated towards defense and humanitarian needs is problematic. President Zelensky has indicated that elections will not be held on credit, nor will funds be diverted from military needs to finance elections​.

Internal and External Opinions

Public Opinion: A significant portion of the Ukrainian population supports postponing elections until the war ends. A survey by the Kyiv International Institute of Sociology found that over 80% of respondents prefer deferring elections until the conflict is resolved​.

International and Domestic Pressure: There is external pressure on Ukraine to demonstrate its democratic credentials by holding elections. However, domestic consensus, including among opposition leaders, supports delaying elections to ensure they are conducted under conditions that uphold democratic integrity​​.

Given these challenges, Ukraine has opted to postpone elections until martial law is lifted and conditions are conducive to holding free, fair, and secure elections. This approach aligns with constitutional requirements and reflects practical considerations to maintain democratic standards and national unity during an ongoing conflict.
